Sports training in the youth sports system in the context of harmonisation of legislation

Objective of the study is to develop proposals for improving the accessibility of sports training for children in the context of harmonising legislation on ‘sport’ and ‘education’.
Methods and structure of the study. General scientific research methods (analysis, synthesis), special methods of jurisprudence (comparative legal, formal legal) were used to develop proposals for improving Russian legislation to increase the accessibility of children's and youth sports activities for the population.
Results and conclusions. Restrictions on the accessibility of sports training for children aimed at inclusion in national sports teams have been identified. One of the factors hindering children's access to sports training is the discrepancy in the legal regulation of the institutions of ‘sports training’ and ‘additional education’. In order to increase the accessibility of sports training for children with talent and ability, the Ministry of Sport of Russia proposes: 1) to initiate the transfer of sports training issues to the framework of educational activities in accordance with the concept laid down in the norm-definition of ‘sports training’; 2) establish a unified methodology for identifying children aged 5 to 18 who are involved in ‘additional education’ activities; 3) assign the authority to control (supervise) sports training and other types of special training for sports competitions to the state authorities of the constituent entities of the Russian Federation in the field of physical culture and sports management, with the invitation of representatives of the education system; 4) continue to harmonise legislation on ‘sport’ and ‘education’, taking into account age-related patterns and the pedagogical nature of the training process, by defining priorities in the regulation of physical culture and sports management bodies; 5) create conditions for adults who have high sports qualifications and/or are members of municipal sports teams to undergo sports training on a budgetary basis and pass on their experience to the younger generation.
